NOTICE IS HEREBY GIVEN THAT on 27 August 2008 Eden District Council, in exercise of its powers under sections 32, 35 and 38 of the Road Traffic Regulation Act 1984, and Schedule 9 to that Act, has made an Order for the regulation of the off-street parking places provided by the Council. The title of the Order is the Eden District Council (Off-Street Parking Places) Order 2008. The Order relates to the following parking places: Broad Close Car Park, Appleby 1. Princes Street Car Park, Penrith 2. Bluebell Lane Car Park, Penrith 3. Sandgate Car Park, Penrith 4. Sandgate Bus Station, Penrith 5. Town Hall Car Park, Penrith 6. Mansion House (Front) Car Park, Penrith 7. Mansion House (Rear) Car Park, Penrith 8. Penrith Leisure Centre Car Park, Penrith 9. Southend Road (Inner and Outer) Car Parks, Penrith The effect of the Order is summarised as follows: 1. The Eden District Council (Off-Street Parking Places) Order 2005 has been revoked and replaced by the Order. 2. The Penrith (Sandgate Bus Station) Order 1973 has been revoked and replaced by provisions in the Order. 3. The Order reflects changes to parking regulation and enforcement regime brought about by the coming into force of Part 6 of the Traffic Management Act 2004. 4. Parking at Penrith Leisure Centre will be regulated; overnight parking between 12 midnight and 6.30am will be prohibited, parking will be restricted to users of the leisure centre and users parking between the hours of 6.30am and 3.45pm will be required to display a ticket obtained from Leisure Centre Reception. 5. The Order clarifies the arrangements for use of the coach parking bays in Sandgate Car Park. 6. The Southend Road Car Parks cease to be parking places covered by an Order made by the Council. 7. The small parking place on the south-west side of Bluebell Lane will be incorporated into the Bluebell Lane Car Park. This area was formerly known as the Bluebell Lane Outer Car Park, and was regulated in the past, but was omitted from Orders made in recent years. 8. No changes to the charges payable in any of the parking places listed above will result from the making of the Order. A copy of the Order may be inspected at the Town Hall, Penrith during normal office hours on Mondays to Fridays. The Order will come into force on 1 September 2008.

If any person wishes to question the validity of the Order or of any of its provisions on the grounds that it or they are not within the powers conferred by the Act, or that any requirements of the Act or of any instrument made under the Act has not been complied with, that person may, within 6 weeks from the date on which the Order is made, apply for the purpose to the High Court.
